The first law restricting the use of opium was enacted in California in 1875. After eight years of heavy lobbying, Congress employed its enumerated powers to tax, to control opium in 1883. Nowhere does the Constitution gives Congress the power to impose moral standards or beliefs; but when the tax was passed in 1883- the moral camel’s nose was under the tent.
